Design patents

An Industrial design right is an intellectual property right that protects the visual design of objects that are not purely utilitarian. An industrial design consists of the creation of a shape, configuration or composition of pattern or color, or combination of pattern and color in three dimensional form containing aesthetic value. An industrial design can be a two- or three-dimensional pattern used to produce a product (as example promotional items and giveaway), industrial commodity or handicraft.

Design patents are a type of industrial design right. Ornamental designs of jewelry, furniture, beverage containers and computer icons are examples of objects that are covered by design patents.

A design patent will only be granted if the design is new and distinctive enough. In case a design has already been used in the market, it is usually classified as not “new”. However, the creator/applicant enjoys a 12-month grace period, in which time the design is still deemed “new”.

A design patent protects the design of a product, promotional items or giveaway for 5 years starting the date of application, and may be prolonged up to maximum 20 years.

The design patent protects the applicants exclusive right of its commercial usage, be it as a whole or part.

Design patents are only granted if the design is novel and not obvious for all items, even those of different utility than the patented object. An actual shield of a given shape, for example, can be cited as prior art against a design patent on a computer icon with a shield shape. The validity of design patents is not affected by whether or not the design is commercialized.

Since the entry into force of Council Regulation (EC) No 6/2001 of 22 December 2000 which replaced the Brussels Convention, the most important national decisions likely to affect the interpretation of the Lugano Convention have also been included.

Technical specs are – in contrast to “normal” patents, without relevance. Desing protection can be used also by promotional products, promotional items and giveaway.
